What does Positively Neutral do to ensure the information published on the website is objective?
We do several things. First, we require mediators, arbitrators and experts to provide us with the names of all the attorneys who have utilized their services during the relevant time frame. Second, Positively Neutral--not the client--decides which attorneys will be surveyed. Third, we do not inform our clients what any particular attorney said about them, thereby promoting candor by the attorneys. Fourth, we do not permit mediators, arbitrators and experts to selectively publish feedback on Positively Neutral's website; their choice is to publish all feedback or no feedback.
-
Why do most of the reviews on Positively Neutral's website contain favorable feedback?
The process described above promotes publication by those mediators, arbitrators and experts who are well-regarded. Those clients who do not obtain favorable feedback likely will choose not to publish the survey results.
-
Why are neutrals and experts not required or permitted to provide Positively Neutral with the names of the parties to disputes where they participated?
Positively Neutral avoids acting in ways that intrude upon party confidentiality.Ý Consequently, we do not request or permit neutrals and experts to disclose to us the names of parties.Ý When a neutral or expert is concerned that attorneys for whom they provided services may not remember the neutral or expert without memory being refreshed by the name of a party, we suggest that the neutral or expert contact the attorneys, reminding them of his or her involvement and that the attorneys should expect to be contacted by us.
